JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,504 and 506/34 of the Indian Penal Code. It is alleged that all the accused persons came to the informant's door when petitioner Bhola Bhagat caused injury on the scrotum of the informant with dagger whereas petitioner Laxman Kumar snatched Rs.4500/-. It is further alleged that other accused also assaulted with lathi, bhala and knife to the informant. It is submitted by the learned counsel for the petitioners that only one lacerated injury on the scrotum of the informant was
Patna High Court Cr.Misc. No.15723 of 2015 (2) dt.06-05-2015 found caused by hard and blunt substance. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the fact that specific accusation of assault by dagger has been levelled against petitioner Bhola Bhagat but since accusation not being corroborated by the injury report, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Madhuban P.S. Case No. 12 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
