====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 05-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Marhowra P.S. Case No.21 of 2016 registered under Sections 272 and 273/34 of the Indian Penal Code besides Section 47-A of the Excise Act. The accusation is that in course of patrolling duty, one pick-up Bolero van was seen coming towards Tehti. On seeing the police force, the driver of the said pick-up van started to flee away but he was apprehended, who disclosed his name as Shatrughan Rai (petitioner) and on search of the aforesaid pick-up van, 11 drums of raw spirit were recovered from the same. On query, the petitioner also disclosed that the said vehicle was hired

Patna High Court Cr.Misc. No.19503 of 2016 (2) dt.05-05-2016 2/2 by one Arun Rai for carrying the same on payment of Rs.800/-. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the driver of the said vehicle and has falsely been implicated in this case. The petitioner having no criminal antecedent is in custody since 20.01.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Saran at Chapra, in connection with Marhowra P.S.
