JUSTICE BIBEK CHAUDHURI ORAL ORDER 27-08-2024 The short question involved in the instant writ petition is as follows :- "The petitioner has been working as a Chain Man (Group-D post) in Land Acquisition Department for 34 years. The petitioner has not been granted 1st and 2nd ACP/MACP, which he is entitled after completion of 10, 20 and 30 years of service.

2. The learned Advocate on behalf of the respondents has not disputed the claim of the petitioner. It is only submitted by the learned Advocate for the respondents that if the petitioner has any grievance in respect of revision of pay under ACP/MACP Rules, he could have filed his grievance before the

Patna High Court CWJC No.12380 of 2024(2) dt.27-08-2024 2/2 Service Grievance Redressal Officer under Bihar Government Servant Redressal Rules, 2019.

It is contended in the definition of complaint in Rule 2(C) of Bihar Government Servant Grievance and Redressal Rules that complaint refers to all matters relating to the service and service benefits of serving and retired person of State Government Servant .......(4) Promotion, ACP/MACP related. So the Service Grievance Redressal Officer is the Competent Authority to dispose of the grievances relating to ACP/MACP of an employee who still serving as Chain Man in the Land Acquisition Department.

The instant writ petition is therefore, disposed of directing the petitioner to submit a complaint, in terms of Rule 2(c) of the Bihar Government Servant Grievance and Redressal Rules, 2019 before the Competent Officer and the Competent Officer is directed to dispose of the representation of the petitioner, within 60 days from the date of communication of this order.

5. Accordingly, the instant writ petition is thus, disposed of.
