The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code and 27 of the Arms Act.
Allegation is 5-6 unknown miscreants caused injury to Guard by fire arms and looted cash of Rs.52 lacs of Axis Bank.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come in this case on confessional statement of co-
Patna High Court CR. MISC. No.52925 of 2019(2) dt.23-08-2019 2/2 accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P. Other co-accused has been granted bail vide Annexure 2 to the application.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge I (West), Muzaffarpur in connection with Saraiya P.S. case No.558 of 2018.
