====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-08-2018 Heard the learned counsel for the petitioners and the learned A.P.P for the State.

The petitioners seek bail in connection with Dhoraiya P.S. Case No. 11 of 2018 registered under Sections 395, 397 and 120(B) of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submit that both the petitioners are not named in the F.I.R.. In course of investigation, the police apprehended both the petitioners on 02.02.2018, showing the recovery of Rs. 6,000/- form the possession of the petitioner no.1 and Rs. 8500/- and a mobile from the possession of the petitioner no.2. Thereafter, confessional statement of the petitioner no.1 was recorded,

Patna High Court Cr.Misc. No.33673 of 2018(3) dt.02-08-2018 2/2 showing his involvement and the involvement of the petitioner no.2 in the present case. Except that, there is nothing against the petitioners. Both the petitioners having no criminal antecedents are in custody since 03.02.2018. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Dhoraiya P.S. Case No.11 of 2018. Out of the two sureties, one must be either parents or the close relative of the petitioners.
