For the Petitioner/s : Mr Amarendra Narayan, Advocate For the S t a t e : Mr Sajid Salim Khan, SC XXV ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 02-07-2018 Learned counsel for the petitioner submits that in so far as the issue regarding the petitioner's posting on lower scale of Class IV post, the order dated 01.04.2015 issued by the Secretary (Expenditure) which is Annexure A to the writ petition, takes care of the writ petitioner inasmuch as he has been posted on the post of Lower Division Clerk which is a Grade III post. It is also submitted that the respondents, by filing supplementary counter affidavit, have clarified the issue regarding admissibility of the benefits under ACP scheme. Patna High Court CWJC No.946 of 2015 (10) dt.02-07-2018 2/2 01.04.2015, the only issue which remains for consideration is whether the petitioner has been placed in his due seniority in the Provident Fund Directorate after his transfer to the said Directorate. He prays that with respect to seniority, he may be granted liberty to raise the issue before the respondent-authorities. In so far as the other relief prayed for in the writ petition, the respondents have redressed all the grievances regarding admissibility of Grade III post and benefits of ACP scheme. In view of the aforesaid submission, the writ petition is permitted to be withdrawn and is dismissed with liberty, as aforesaid.
