The petitioners apprehend their arrest in Korha P.S. Case No.267 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case and there is general and omnibus allegation of assault and even in the postmortem report no injury was found on the person of the deceased and land dispute is going on between the parties. Heard learned A.P.P. also, who does not controvert this fact.
Having heard both sides. In view of the facts as stated above and considering the fact that the investigation is still
Patna High Court Cr.Misc. No.6250 of 2017 (2) dt.17-02-2017 going on, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No.267 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that bailors should be local having sufficient immovable property within the jurisdiction of the court concerned and petitioners shall cooperate in the investigation and make themselves available before the police as and when required and further that during investigation if any serious materials come against these petitioners the prosecution is at liberty to move for cancellation of bail bond of the petitioners.
