The petitioner being the father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
Accusation is of killing the daughter of the informant after six years of marriage.
It is submitted by the learned counsel for the petitioner that, in fact, specific accusation is against the husband of the victim, who performed second marriage. The post-mortem reflect no external injury and accusation is not specific against the petitioner, rather subsequently informant was filing a petition before the Gram Kutchery, admitting that the petitioner has no hands in the commission of offence.
Patna High Court Cr.Misc. No.14066 of 2015 (2) dt.11-05-2015 Considering the death after six years of marriage and specific accusation is against husband of the deceased, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Rosera, Samastipur in connection with Bibhutipur P.S.
