JUSTICE ARUN KUMAR ORAL ORDER 11-05-2018 None appears on behalf of the petitioner, however, learned counsel appearing on behalf of the O.P. No. 2 is present. Petitioner has filed the present quashing application for quashing the order dated 20.11.2014 passed in S.C. No. 621 of 2014 for discharge the petitioner from this case in which cognizance has been taken under Section 498A of IPC and Sections 3 and 4 of the Dowry Prohibition Act. Report of the trial court indicates that already charge has been framed and the case is fixed for evidence and the stage of the case has also changed.

Considering the material on record, it is not that no prima facie case under Section 498A of I.P.C. is made out

Patna High Court Cr.Misc. No.52104 of 2014(3) dt.11-05-2018 2/2 against the petitioner-husband of the complainant. Having so, application is bereft of any merit. Accordingly, it stands dismissed.
