2. The petitioner apprehends his arrest in a case registered for the offence under Sections 126(2), 115(2), 118(2), 109, 352, 351(2), 3(5) & 103(1) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that on the alleged date and time of occurrence, 15 F.I.R. named accused persons including petitioner and 4 - 5 unknown persons assaulted uncle of the informant, namely, Ajay Bind, by means of lathi, sword and knife, as a result of which, he fell down. It is further alleged that when the informant and others came to save him (uncle of informant), they were also assaulted by the accused persons. The uncle of the informant died during course of treatment.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and has been falsely implicated in this case. Allegation of assault is general and omnibus and no specific overt act has been alleged against this petitioner. He further submits that from perusal of post-mortem report, the uncle of informant died due to shock, as a result of head injury. Case and counter case. Some of the similarly situated co-accused persons have already granted bail by this Court. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bhojpur, Ara in connection with Shahpur P.S. Case No. 63 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
