====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 05-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No.154 of 2015 registered under Sections 324, 307 and 302 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that the petitioner alongwith co-accused Rana Singh came at the door of the informant/deceased Onkarnath Srivastava for his treatment. While the informant/deceased was engaged in checking the petitioner, the co-accused Rana Singh took out a pistol and shot fire at the informant/deceased and, thereafter, both moved from there. Later on, in course of

Patna High Court Cr.Misc. No.19541 of 2016 (2) dt.05-05-2016 2/2 treatment, the informant/deceased died on 28.08.2015. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the co-villager of the informant/deceased. It would appear from the F.I.R. that there is allegation of making firing at the informant against the co-accused Rana Singh and no specific overt act has been attributed to the petitioner. The petitioner is in custody since 20.01.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Bhagwanpur Hat P.S. Case No.154 of 2015.
