JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 420, 467, 468, 471, 509, 500, 505, 292, 292A, 292B of the Indian Penal Code.
It is alleged that the petitioner somehow created the photographs of the daughter of the victim and is spreading rumor that he has married with the daughter of the informant and thereby he has tarnished the prestige of the informant. It is submitted by learned counsel for the petitioner that the petitioner married with the daughter of the informant and has also filed Matrimonial Case No.202 of 2013 for restitution of the conjugal right before the learned Principal Judge, West
Patna High Court Cr.Misc. No.13911 of 2015 (2) dt.03-04-2015 2/2 Champaran at Bettiah on 24.06.2013 in which daughter of the informant entered appearance and thereafter the present complaint case has been filed.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Chhapra, Saran in connection with Complaint Case No.2664 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
