JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26II/35 of the Arms Act, Section 3⁄4 of Explosive Substance Act and Section 414 of the Indian Penal Code.

One country made loaded rifle and 13 live cartridges are said to have been recovered from the conscious possession of the petitioner, when the petitioner was arrested from the house of one Jitendra Paswan @ Bahira. It is alleged that 40 live bombs were recovered from the house of the aforesaid co-accused Jitendra Paswan @ Bahira, whereas firearm and cartridges were recovered from the possession of other accused.

Patna High Court Cr.Misc. No.20240 of 2016 (2) dt.10-08-2016 2/2 Submission on behalf of the petitioner is that the petitioner is in custody since 15.03.2015 and co-accused Jitendra Paswan @ Bahira has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Vaishali in connection with Hajipur Sadar P.S. Case No. 121 of 2015, Sessions Trial No. 73 of 2016.
