JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case filed with accusation for the offences punishable under Sections 420, 406, 120B of the Indian Penal Code wherein process has been directed to be issued after cognizance being taken. It is alleged that when the informant came to know that Manoj Singh executed Power of Attorney with regard to his land in favour of the petitioner then the complainant made payment of Rs.
3,00,000/- each to Manoj Singh and his father Nawlakh Singh through two cheques as consideration money for purchase of eleven dhurs of land. The sale deed was supposed to be executed by this petitioner but in spite of receiving payment of consideration money by Manoj Singh no sale deed was executed.
Patna High Court Cr.Misc. No.15107 of 2015 (2) dt.13-05-2015 2/2 petitioner is owner of the alleged land. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saram at Chapra in connection with Complaint Case No.2775 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
