The present application under Section 482 of the Code of Criminal Procedure has been filed for restoration of Cr.Misc. No. 14839 of 2016 which stood dismissed due to late compliance of the peremptory order dated 04.02.2016 passed by this Court.

It is contended that the delay was caused due to

Patna High Court Cr.Misc. No.22618 of 2016 (2) dt.14-07-2016 2/2 unavoidable and compelling circumstances. It is neither intentional nor deliberate. The petitioner has got good case on merits and, though late, the order passed by this Court has been complied with.

Regard being had to the submissions advanced at the Bar, the prayer is allowed. Let Cr.Misc. No. 14839 of 2016 be restored to its original file.
