JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in shankarpur P.S. Case No.8/15 registered under Sections 364, 365, 34 of the I.P.C.

The accusation is of kidnapping of Chhotu Kumar, the Munshi of contractor, Rajendra Kumar, who happens to be the informant, for ransom of Rs.2/- lacs. The victim was engaged as munshi of the informant for construction work of the road. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., rather his name surfaced in the confessional statement of co-accused Chandramani Azad, who along with the petitioner confined the victim for demanding

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail which shall be considered by the trial court on its own merit without being prejudiced by this order.
