JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-08-2018 The petitioner was convicted under Sections 447, 435, 337 and 511 / 149 of the I.P.C. by the learned Additional Chief Judicial Magistrate-X, Gopalganj in connection with Gopalganj P.S. Case No. 109 of 1997 by judgement and order dated 15.09.2016 and he was sentenced to undergo RI for three years and to pay a fine of Rs. 5,000 /- (five thousand) under Section 435 of the I.P.C.; RI for three months and to pay a fine of Rs. 500/- (five hundred) for each of the offences under Sections 447, 337/ 511 of the I.P.C. The sentences were ordered to run concurrently.

Aggrieved by the aforesaid judgement and order of conviction, the petitioner preferred an appeal bearing Cr. Appeal No. 114 of 2016 before the learned District & Sessions Judge, Gopalganj.

Patna High Court CR. REV. No.668 of 2018(4) dt.28-08-2018 2/3 The Appellate Court issued notice to the informant on steps to be taken by the petitioner and others.

For the petitioners not taking steps for issuance of notice within the stipulated time, the appeal was dismissed.

After the dismissal of the appeal, the petitioner was arrested on 15.04.2018.

Under the aforesaid circumstances, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - X. Gopalganj in connection with Gopalganj P.S. Case No. 109 of 1997.

This Court has further been informed that the appeal of the other appellants, which too was dismissed, has now been restored.

The appeal of the petitioner also stands restored.

The petitioner shall appear before the Appellate Court with a copy of this order and shall undertake to comply the order of the Appellate Court within the stipulated time, as fixed by the Appellate Court. It is expected that the Appellate Court shall hear the appeal

With the aforesaid observation, the revision petition is disposed off.
