JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Baruraj P.S. Case No. 132 of 2014, registered under Section 366 and 366(A) of the Indian Penal Code.

The accusation is that petitioner being the friend of daughter of the informant accompanied the daughter of the informant on 10.08.2014 at about 11.00 A.M. and at short distance Mukesh Kumar was standing with motorcycle who accompanied both for Mehsi. While petitioner returned to her house, but daughter of the informant did not return in spite of search no trace was found.

Learned counsel for the petitioner submits that there

Patna High Court Cr.Misc. No.19782 of 2016 (2) dt.12-05-2016 2/2 was love affair in between the victim and Mukesh Kumar, but the petitioner has been falsely implicated in this case mere on suspicion. Moreover, the victim herself returned to her house and gave her statement making allegation as narrated in the F.I.R. regarding her kidnapping. Co-accused Mukesh Kumar @ Mukesh Pandit has been granted privilege of bail by a coordinate Bench of this Court vide order dated 07.10.2015 passed in Criminal Misc. No. 36249 of 2015. The petitioner being lady is in custody since 21.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar, J.M.1st Class, Muzaffarpur in connection with Baruraj P.S.
