The petitioner has prayed for bail in a case instituted for the offence under Sections 304/34 of the Indian Penal Code. Prosecution case relates to death of informant' father due to electrocution in agricultural field while he was irrigating the crops. It is further alleged that petitioner is using the electricity without valid connection and he has laid the naked wire in field with ill motive.

It is submitted by learned counsel for the petitioner that he has been falsely implicated in this case due to previous enmity. Informant is not the eye witness of the alleged occurrence. He has committed no offence. Only on the basis of suspicion, his name has been dragged in the present case.

Patna High Court CR. MISC. No.57878 of 2023(3) dt.06-11-2023 2/2 Petitioner is languishing in judicial custody since 24.6.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Bhojpur, Ara in connection with Jagdishpur P.S. Case No. 197 of 2023.
