JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 448, 504 and 376/511 of the Indian Penal Code. It is alleged that these petitioners assaulted the sister of the informant when she protested against attempt of committing rape and when the informant came to rescue, he was also assaulted.

It is submitted by learned counsel for the petitioners that the petitioners are the cousin of the informant and his sister and in the background of land dispute, the accusation has been levelled when the injury of the informant and his sister has been found to be superficial simple in nature. During investigation, it has transpired that petitioner nos. 1 and 3 were not present at the place

Patna High Court Cr.Misc. No.156 of 2015 (2) dt.07-01-2015 of occurrence. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the nature of accusation, it is a case for consideration of regular bail.

Let the learned court below consider the regular bail application of the petitioners if they surrender within a period of six weeks in connection with Pakribarawan P.S. Case No. 142 of 2014 pending in the court of learned SDJM, Nawada. Accordingly, the application is disposed of.
