This modification application has been filed for extension of period of surrender.

Learned counsel for the petitioners submits that that petitioners were granted the privilege of anticipatory bail by this Court vide order dated 28.11.2016 passed in Criminal Miscellaneous No. 43183 of 2016 with direction to surrender before the Court below within a period of four weeks from the date of receipt/production of copy of the aforesaid order but petitioners were outside the state in connection with earning their livelihood and could not surrender before the Court below within the time as fixed by this Court.

Patna High Court Cr.Misc. No.11344 of 2017 (2) dt.15-03-2017 2/2 Now petitioners want to surrender before the Court of Chief Judicial Magistrate, Banka/concerned Court in connection with Banka P.S. Case No. 168 of 2016.

In view of the above, further period of six weeks is granted to the petitioners to surrender before the court below in connection with Banka P.S. Case No. 168 of 2016. Accordingly, order dated 28.11.2016 passed in Criminal Miscellaneous No. 43183 of 2016 is modified to the above stated extent. The other conditions imposed by the above stated order shall remain enforce.
