JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 447, 307 and 337 of the Indian Penal Code. It is alleged that when the informant made protest for entering on the land of the informant, petitioner no.1 assaulted to Gulbia Khatoon with axe when others assaulted the informant and the informant's wife.
It is submitted that the accusation of assaulted is omnibus and general except against petitioner no.1 who is alleged to have assaulted Gulbia Khatoon with axe but Gulbia Khatoon found to have received only two lacerated superficial
Patna High Court Cr.Misc. No.14128 of 2015 (2) dt.07-04-2015 2/2 injuries caused by hard and blunt substance. There is counter version of the occurrence also and the accusation has been levelled in the background of the land dispute. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bagaha, West Champaran in connection with Thakaraha (Bhitaha) P.S. Case No. 88 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
