The petitioner is languishing in custody since 01.02.2016 in connection with Neema Chandpura P.S. Case No. 82/2015 for the offences instituted under Section 386 of the IPC. The prosecution story, in brief, is that the informant received mobile calls on his mobile and the caller demanded Rs. 15,00,000/- otherwise both the brothers would be killed. Later on, demand was reduced to Rs. 5,00,000/- which was not given then it was increased to Rs. 10,00,000/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.02.2016 and the charge sheet has been submitted in the present case. The petitioner is not named in

Patna High Court Cr.Misc. No.20361 of 2016 (3) dt.19-07-2016 2/2 the F.I.R. In course of investigation, it has come that ransom was demanded from the mobile of the petitioner. The said evidence has come in paragraph no. 39 of the case diary. Except for this there is no evidence to implicate the petitioner in the present case. On behalf of the State it has been submitted that the petitioner is not named in the F.I.R. but he has as many as five cases pending against him.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Neema Chandpura P.S. Case No. 82/2015, pending in the court of the learned J.M. Ist Class, Begusarai. U.K./- (Sudhir Singh, J) U T
