Petitioner seeks regular bail in connection with Dhankund PS Case No. 87 / 2021 ( Special Case No. 05 / 2021 ) instituted for the offence under Section 20 (b) / 22 (b) of the NDPS Act.

One motorcycle on which two persons were riding was intercepted by the police and from possession of one of them 01 kilo Ganja has been recovered and the another person who was sitting on the motorcycle succeeded in fleeing away. The name of petitioner has been disclosed by the person from whose possession Ganja has been recovered.

Learned counsel for the petitioner submits that name of petitioner has been disclosed by the arrested co-accused and he has not committed any offence in the manner alleged. The

Patna High Court CR. MISC. No.67886 of 2021(2) dt.23-05-2022 2/2 petitioner is having no criminal antecedent and no contraband Ganja has been recovered from his possession. The petitioner is in custody since 21/08/2021 and charge sheet has already been submitted.

Regarding being had to the submissions made by the parties, taking into consideration the fact no contraband Ganja has been recovered from his possession, he is having no criminal antecedent, petitioner is in custody since 21/08/2021 and charge sheet has been submitted, and as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Banka in connection with Dhankund PS Case No. 87 / 2021 ( Special Case No. 05 / 2021 ).
