JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-11-2022 This application has been filed seeking modification of one of the conditions imposed by this Court whereunder the father of the petitioner has been asked to stand as a surety and furnish an undertaking.

Learned counsel for the petitioner submits that father of the petitioner is also an accused in this case and he is in jail, therefore, he cannot stand as surety. Learned counsel submits that inadvertently and in absence of instruction, he could not bring this fact to the notice of this Court on 07.09.2022 when the Criminal Revision No. 440 of 2021 was taken up for consideration.

Learned counsel for the State does not oppose this application.

In the given facts and circumstances, the application

Patna High Court CR. MISC. No.55553 of 2022(2) dt.09-11-2022 2/2 is allowed. The condition imposed in the order dated 07.09.2022 whereunder the father of the petitioner has to stand as surety and furnish an undertaking is modified to the extent that in place of father, now mother of the petitioner shall stand as a surety and furnish an undertaking. Rest of the order dated 07.09.2022 passed in Cr. Revision No. 440 of 2021 shall remain intact.
