Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner is named in the first information report with allegation that at the time of alleged occurrence, he was carrying rifle in his hand but it is only stated that petitioner was a member of unlawful assembly and so far as causing injury to the injured as well as death of deceased of the present case is concerned, the same is said to have been caused by other coaccused. Moreover, having more or less similar allegation, coaccused, Nazir Miyan and Mahendra Mukhiya have already been

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that no specific overt-act has been attributed against the petitioner and co-accused have already been released on bail, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S.
