ANJANA MISHRA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

Learned counsel for the petitioners is permitted to make the necessary correction in the provision of para-1 and 6 of the anticipatory bail application.

The petitioners are apprehending their arrest in connection with Jurawanpur P.S. Case No.02 of 2016 registered for the offences punishable under Sections 304B,201/34 of the Indian Penal Code.

Cade diary was called for, which has since been received.

No.23828 of 2016 (3) dt.09-08-2016 2/3 After hearing the learned counsel for the petitioners and learned counsel appearing on behalf of the State, it appears that the girl in question was missing from the petitioners' house. The information to said effect was given by the husband, namely, Binay Bhagat, Petitioner no.3 herein. It is evident that petitioner no.3 Binay Bhagat was present in the house at the time the victim girl disappeared. So far as the other petitioners are concerned, namely, Satan Bhagat @ Satya Narayan Bhagat @ Satnarayan Bhagat (petitioner no.1), Sangeeta Devi (petitioner no.2), Kalawati Devi (Petitioner no.4) and Sanjay Bhagat (Petitionr no.5) are the other family members of the husband of the lady who is said to have disappeared.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that the petitioner no.3 being husband was responsible for the safety of the victim lady. He further submits that the girl has not yet been recovered. Considering the entire facts and circumstances of the case, let the petitioners, namely, Satan Bhagat @ Satya Narayan Bhagat @ Satnarayan Bhagat, Sangeeta Devi, Kalawati Devi and Sanjay Bhagat, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be enlarged on bail on

Patna High Court Cr.Misc. No.23828 of 2016 (3) dt.09-08-2016 3/3 furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Hajipur, Vaishali in connection with Jurawanpur P.S. Case No. 02 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The prayer of petitioner no.3, namely, Binay Bhagat, the husband of the victim lady stands rejected.
