ANJANA MISHRA ORAL ORDER 25-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.06.2019 in connection with Warisaliganj P.S. Case No.83 of 2019 registered for the offence under Sections 323, 332, 333, 353/34 of the Indian Penal Code and Section 40 of the Bihar Mining Mineral Concession Rule, 1972 and Sections 03 and 08 of Bihar Mining Illegal Mining Transportation and Storage Rules, 2003.
Learned counsel for the petitioner submits that the petitioner has nothing to do with the illegal mining of sand and its transportation and only because he was one of the bystanders who had come to see as to what was happening, the petitioner has been falsely implicated in connection with
Patna High Court CR. MISC. No.56302 of 2019(2) dt.25-09-2019 2/2 the present case. It is further submitted that similarly situated persons, who were also arrested from the place of occurrence, have since been granted bail by the court below as has been stated in paragraphs 15, 16, 17 and 18 of the present bail application.
Considering the aforementioned facts and circumstances and that the petitioner is in custody since 24.06.2019 and was a member of the crowd, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Nawada, in connection with Warisaliganj P.S. Case No.83 of 2019.
