JUSTICE ARUN KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Mokama P.S. Case No.105 of 2015 registered for the offence under Sections 147, 148, 149, 324, 307, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that all the accused persons including the petitioner shot at the deceased who sustained several gun shot injuries.

Learned counsel for the petitioner submits that there are two places of occurrence. There is no veracity of the prosecution case and the deceased himself was a veteran criminal of the area.

No.9649 of 2017 (4) dt.22-03-2017 2/2 However, as the allegation of shooting at the deceased is against the petitioner also so it is not a case of anticipatory bail, hence prayer for anticipatory bail is rejected. However, the petitioner, if so advised, may surrender before the court below and pray for regular bail which shall be considered on its own merit without being prejudiced by this order.
