The petitioners seek bail in Dumariya P.S. Case No.02 of 2017, registered under Sections 386 and 387/34 of the Indian Penal Code.
The learned counsel for the petitioners submits that the prayer for bail of the petitioners was earlier rejected vide order dated 18.05.2017 passed in Cr. Misc. No.15770 of 2017 but the trial has not yet been concluded. The petitioners are in jail since 03.01.2017. Petitioners have already remained in jail for one year and eight months. Petitioners were of course apprehended on the spot but nothing has been recovered from their possession. It is further submitted that the petitioners have got
Patna High Court Cr.Misc. No.34143 of 2018(3) dt.12-09-2018 2/2 no criminal antecedent as has been stated on oath in para 3 of the bail petition.
Taking into consideration the facts aforesaid and the fact that the petitioners have got no criminal antecedent and they have remained in jail for about one year and eight months and the trial has not yet been concluded, the petitioners, named above, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Sherghaty, Gaya in connection with Dumariya P.S. Case No.02 of 2017.
