JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-07-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with

Patna High Court CR. MISC. No.65145 of 2021(2) dt.27-07-2022 2/3 Nadi P.S. Case No. 257 of 2021, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code & Rule 56 of the Minerals Concession Prevention of Illegal Mining Transportation & Storage Amendments Rules.

As per allegation, two tractors loaded with sand were seized by the police. The drivers became successful in fleeing away.

Learned counsels for the petitioners have submitted that the petitioners are driver and owner of the seized tractors. They are the persons of clean antecedents. They have also submitted that the police was illegally realizing money from the tractors and they were lodging case and expected the petitioners to become seizure list witnesses to which they denied and it was the reason of their false implication.

Considering the above-mentioned facts and circumstances, especially, the clean antecedents of the petitioners, let them, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court of Smt. Payal Singla, J.M. 1st, Class, Patna City, Patna in connection with Nadi P.S. Case No. 257 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

No.65145 of 2021(2) dt.27-07-2022 3/3 Within three months of release of the petitioners, their criminal antecedents must be verified by the court below and if it is found that they are inducted in any other case the learned court below shall be at liberty to cancel the bail bond.
