JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sultanganj P.S. Case No. 242 of 2015, registered under Sections 147, 148, 149, 353 and 307 of the Indian Penal Code and Section 27 of Arms Act.

The accusation is that in course of investigation of Sultanganj P.S. Case No. 240 of 2015, when Police reached near crematorium then some persons were seen by the Police. On seeing the Police party, they started to flee away. Out of them four persons were apprehended, who disclosed the name of his associates, who succeeded to flee away, as Vineet Kumar (Petitioner) and Amit Kumar.

Learned counsel for the petitioner submits that it

Patna High Court Cr.Misc. No.19687 of 2016 (2) dt.11-05-2016 2/2 would appear from the F.I.R. that petitioner was not apprehended on the spot rather his name has been disclosed by four co-accused, who are said to be apprehended by the Police. Further submission is that, in fact, the petitioner is accused in Sultanganj P.S. Case No. 166 of 2015 registered on 07.08.2015, under Section 341, 323, 327, 506/34 of the I.P.C. and 27 of Arms Act, thereafter, the petitioner has been remanded in the present case on 09.02.2016 and he was also remanded in Sultanganj P.S. Case No.240 of 2015 and Sultanganj P.S. Case No. 241 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 242 of 2015 (G.R. No. 4443 of 2015). Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
