The petitioner seeks bail in a case registered under Sections 363, 364 of the Indian Penal Code.

Prosecution case, in short, is that while the informant was going to his house on a motorcycle with his daughter Rupa Kumari, 8-10 miscreants intercepted him and started assaulting him, out of which one of the miscreants on the point of gun forcibly took his daughter on a car. The miscreants assaulted the informant and took cash Rs.1200/-, driving license and key of motorcycle from the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.05.2019 and has got no

There is no allegation of tampering of witnesses alleged against the petitioner. The victim has already been examined under Section 164 of Cr.P.C. She has not named the petitioner. Other co-accused has been granted bail vide Cr.Misc.No.51977 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate V, Samastipur in connection with Samastipur (Muffasil) P.S. case No.241 of 2019.
