The petitioner apprehends his arrest in Complain Case No. 664 of 2021, registered for the offences punishable under Sections 420, 406, 504 of the Indian Penal Code and section 138 of the Negotiable Instruments Act.

It is a case of cheque bounce. It is alleged that cheque issued by the petitioner got dishonoured due to insufficiency of fund.

It is submitted that petitioner is ready to deposit the amount of Rs. 4,00,000/- in four installments. First installment of Rs. 1,00,000/- will be paid at the time of furnishing bail bond

Patna High Court CR. MISC. No.67794 of 2021(4) dt.05-09-2022 2/2 and rest of Rs. 3,00,000/- in three installments within one year. In view of the undertaking given by the petitioner, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Banka in connection with Complain Case No. 664 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with further condition that first installment of Rs. 1,00,000/- will be paid at the time of furnishing of bail bond and rest of Rs. 3,00,000/- in three installments within one year, failing which the bail bond of the petitioner will be cancelled by the learned court below itself.
