Petitioner is accused in connection with Akodhi Gola P.S. Case No. 123 of 2015 registered under Section 302/34 of the I.P.C.
The accusation is that mother of the informant was sitting at the door of the neighbour where Santosh Singh, his father Hazari Yadav and his mother Madhuri Devi, petitioner came and attacked through spade at her head, due to which she sustained injury and died. At that time, the informant was not at his house and when he came his house then he was informed about the occurrence.
Patna High Court Cr.Misc. No.20640 of 2016 (2) dt.17-05-2016 2/2 Submission is that while the petitioner is lady, who is named in the F.I.R. along with two others accused, who are husband and son by the informant. In the Postmortem Report, only one head injury is found 3" x 3" x muscle deep with bruise on right side of the chest and fracture of 4th and 5th ribs. In fact, the petitioner, who is lady being mother and wife of the co-accused have falsely been implicated in this case and having no criminal antecedent, is in custody since 30.11.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII, Rohtas, Shasharam in connection with Akodhi Gola P.S. Case No. 123 of 2015.
