JUSTICE ARUN KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Araria Mahila P.S. Case No.40 of 2014 registered under Section 376 of the Indian Penal Code.

Allegation in brief is that this petitioner has committed rape with the prosecutrix.

Learned counsel appearing on behalf of the petitioner submits that in fact the prosecutrix is cousin of the petitioner and she wanted to marry with the petitioner, so false allegation was levelled.

However, there is specific allegation against the petitioner of committing rape, so his prayer for anticipatory bail is rejected. However, if so advised, the petitioner may seek regular

Patna High Court Cr.Misc. No.5779 of 2017 (3) dt.18-03-2017 2/2 bail and the same shall be considered on its own merit without being prejudiced by this order.
