The petitioner is languishing in custody since 23.09.2014 in a case registered for the offences punishable under section 364A/34 of the Indian Penal Code.
The prosecution case is that while the informant was coming to home on a motorcycle his motorcycle got struck, in the meantime, six persons came on a Bolero vehicle and tried to take the informant into their Bolero vehicle. On alarm being raised, the three accused persons took the informant on the Bolero vehicle while the three others were left on the spot. However, the informant managed to get him released and when the informant came to the spot he found that the three left persons were apprehended by the villagers and assaulted, who
Patna High Court Cr.Misc. No.14309 of 2015 (4) dt.03-07-2015 2/2 are Mukhtar Singh, Vijay Manjhi and the petitioner. It is submitted by learned counsel for the petitioner that it appears absurd that the petitioner being the member of kidnapping gang was left on the spot and the informant was also being released by the kidnappers without realization of any ransom. It is further submitted that the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the facts that the petitioner was not with the informant while the informant was kidnapped and taken in the the Bolero vehicle and the petitioner has no criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Kateya P.S. Case No.223 of 2014.
