The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 109, 147, 148, 149, 186, 341, 323, 324, 307, 353, 387, 333, 427, 504, 506, 120B of the Indian Penal Code and 4 of the Prevention of Damage to Public Property Act, 1984. It is alleged that the mob were protesting against the murder of one Amit Kumar @ Amrit Kumar were demanding compensation of Rs. 5,000,00/- and when the police party reached to remove the blocked then the police personnels were assaulted by the mob.
It is submitted by the learned counsel for the petitioner that accusation is omnibus and general in nature against the mob and statement has been made in para-3 of the
Patna High Court Cr.Misc. No.14720 of 2015 (2) dt.10-04-2015 petition that petitioner has no criminal antecedent. Similarly situated co-accused have been granted anticipatory bail vide Cr. Misc. No. 11039 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 46 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
