JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420 and 506/34 of the Indian Penal Code.

It is alleged that co-accused Rekha Devi and Akhilesh Prasad Choudhary came and asked the complainant to vacate the land on which the complainant constructed his house after purchase, consequently, the complainant came to know that the co-accused Akhilesh Prasad Choudhary transferred the land in question in favour of his wife in the year 1990. The petitioner is a witness to the sale deed.

It is submitted by learned counsel for the petitioner that there is share dispute between the co-accused Akhilesh Prasad

Considering the nature of accusation and the fact that thrust of accusation is against Akhilesh Prasad Choudhary, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Complaint Case No. 1282 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
