Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Lauriya P.S. Case No. 128 of 2021 lodged under Sections 363, 366A, 504, 34 of the I.P.C. and Section 8 of POCSO Act. As per the prosecution case, the allegation of kidnapping of informant's daughter is there in the F.I.R. Learned counsel for the petitioner submits that the recovery of the alleged victim has taken place in this case and in her statement under Section 164 of Cr.P.C., she completely denied the prosecution story and stated that she herself visited the house of her grandmother. Counsel submits that the police has submitted final form and found this case untrue. He submits that after the submission of final form Court has taken

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 06.06.2022 having clean antecedent.

Learned counsel for the State opposes the prayer for bail and submits that final form has been submitted in this case by the police.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District and Sessions Judge cum Special Judge, POCSO at Bettiah, West Champaran in connection with Lauriya P.S. Case No. 128 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
