The petitioner apprehends his arrest in Buxar (Industrial Area) P.S. Case No. 89 of 2021, registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
As per the FIR, some unknown miscreants committed theft of jewellery and cash from the house of informant. It is submitted that petitioner is not named in the FIR. Name of petitioner came into light during course of investigation on the basis of confessional statement of coaccused. Save and except confessional statement there is no material against this petitioner. Seized articles as cash and ornaments have been recovered from possession of co-accused
Patna High Court CR. MISC. No.67753 of 2021(2) dt.18-07-2022 2/2 Ravi Kumar Gupta and no incriminating article has been recovered from possession of this petitioner and he claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial Area) P.S. Case No. 89 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
