Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 4.8.2017 passed in Cr. Misc. No.34923 of 2017 with a direction to the learned trial court to conclude the trial within a period of nine months. Submission of the learned counsel for the petitioner is that the informant has not supported the case of the prosecution during the trial and the people of the vicinity has not supported the case of the petitioner. He is in custody since 14.9.2016. Heard learned A.P.P. also and from perusal of the report it appears that the case is pending for evidence of two witnesses including the I.O. and for that steps have already been taken.

Patna High Court Cr.Misc. No.40720 of 2018 (4) dt.31-10-2018 2/2 In such view of the matter, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months.

At the same time, the S.P., Jamui is directed to ensure presence of the witness on the date fixed and the learned trial court is directed to conduct it on regular basis so that it may be concluded without further delay.

With the aforesaid observation, this application is dismissed.
