JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 06-08-2015 By filing this application under Articles 226 and 227 of the Constitution of India, the petitioners seek quashing of the first information report in connection with Kankarbagh P.S. Case No. 418 of 2014 registered for the offences punishable under Sections 498-A read with 34 of the Indian Penal Code as well as Section 3 and 4 of the Dowry Prohibition Act.
Patna High Court Cr. WJC No.22 of 2015 dt.06-08-2015 2 / 2 Learned counsel for the petitioners submits that the informant of the case is in the habit of filing false cases. He contends that there is absolutely no truth behind the allegation made in the FIR.
Be that as it may, the allegations made in the FIR do constitute a cognizable offence. The defence of the accused cannot be looked into by this Court at the stage of investigation.
