JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State The petitioner apprehends his arrest in connection with Mehandiganj P.S. Case No. 19 of 2015 registered under Section 304B, 201 and 120Bof the Indian Penal Code. The accusation is of killing of daughter of the informant due to non-fulfilment of demand of dowry. Learned counsel appearing on behalf of the petitioner submits that it would appear from the FIR that after receiving information about admission of the deceased in PMCH, Patna, the informant mother of the deceased and her other family members reached there and in their presence the wife of the petitioner died and the dead body was handed over for cremation but later on, the

Patna High Court Cr.Misc. No.13444 of 2017 (2) dt.02-05-2017 2/2 informant, who is mother of the deceased, lodged present case. Moreover, cause of the death of the deceased was of chronic renal failure not by sustaining injury as alleged in the FIR. The petitioner is husband of the deceased.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Patna City, in connection with Mehandiganj P.S. Case No. 19 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Ravi/- U T
