JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 30-06-2015 Heard learned counsel for the petitioner, learned counsel for the informant and the State.

The petitioner has been made accused in connection with Kotwali (Adampur ) P.S.Case No. 438 of 2014 for the offences under Sections 420, 468 and 34 of the Indian Penal Code on the basis of the report lodged by the informant alleging that the vendor Luxman Chuniyara sold the land which was already decreed in a title suit. The petitioner has falsely been implicated in this case having no criminal antecedent.

In the facts and circumstances of the case, in the event of his arrest/surrender in the court below within four weeks, the above named petitioner shall be released on bail on furnishing bail

Patna High Court Cr.Misc. No.1701 of 2015 (4) dt.30-06-2015 2/2 bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Kotwali (Adampur ) P.S.case No. 438 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. with further following conditions:

(i) one of the bailors shall be own/close family member of the petitioner.

(ii) As soon as charges are framed, the petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates the trial court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
