Earlier the bail application of petitioner was rejected vide order dated 25.06.2021.

It is submitted that charge has already been framed on 02.03.2022. Similarly situated co-accused Rakesh Kumar @ Rakesh Roushan and Guddu Kumar have been granted bail by coordinate Bench of this Court vide order dated 24.02.2021 passed in Cr. Misc. No. 901 of 2021 and dated 16.04.2021 passed in Cr. Misc. No. 6065 of 2021. Petitioner is in custody since 16.08.2020 having clean antecedent.

Considering the fact that similarly situated co-accused have been granted bail by coordinate Bench of this Cour, the petitioner above-named, is directed to be enlarged on bail on

Patna High Court CR. MISC. No.67340 of 2021(5) dt.09-03-2022 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIII, Gaya in connection with Atri P.S. Case No. 280 of 2020.
