JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsel for the petitioners and the State.
Petitioners are languishing in custody since 25.11.2014 in a case registered for the offences punishable under Sections 395 of the Indian Penal Code.
It is alleged that from the informant Rs.
Patna High Court Cr.Misc. No.11431 of 2015 (3) dt.29-06-2015 2,80,000/, Mobile and Motorcycle were robbed, leading to registration of the present case against unknown. It is submitted by the learned counsel for the petitioners that during investigation robbed mobile was recovered from the petitioner Arman Ali, where the name of the petitioner Ajay Manjhi sprang up on the confessional statement of Arman Ali. Ajay Manjhi given Rs. 8500/- to Ravish Kumar Singh and from Ravish Kumar Singh Rs. 8500/- were recovered. Statement has been made in paras10 and 13 of both the petitions that the petitioners were not put on T.I.P. The recovered mobile were also not put on T.I.P. Statement has been made in para-3 of the petition that both the petitioners have no criminal antecedent. Investigation has already been concluded.
Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 524 of 2014.
