Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Bhagwanpur P.S. Case No. 116 of 2022, disclosing offence punishable under Sections 341, 323, 324, 354, 379, 307, 504, 506, 34 of the IPC.

It is the case of the prosecution as disclosed in the FIR that when the informant was sitting in her house, the accused persons including this petitioner entered into her house and started abusing her. On protest, the petitioner is said to have caught the informant's hair and threw her on the ground and thereafter gave a sickle blow on her head. Subsequently, other family members rushed to rescue her. It is alleged that the

Learned counsel appearing on behalf of the petitioner has submitted that the accusation against the petitioner that he had given a sickle blow on the head of the informant is falsified by the medical report from which it transpires that the injury was found to be simple caused by hard and blunt substance on the head of the informant. He has further submitted that for an occurrence said to have taken place on the same date, at the same time and at the same place, a counter case has been filed. Be that as it may, considering the submissions advanced on behalf of the petitioner that the injury allegedly caused by the petitioner has been found on the person of the informant to be simple in nature, this application is allowed. Let the petitioner, namely, Raj Kishor Singh, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in Bhagwanpur P.S.
