JUSTICE JYOTI SARAN ORAL ORDER 18-05-2015 Heard Mr. Rajendra Narain, learned senior counsel appearing for the petitioners, learned counsel for the State as well as Mr. Vindhyachal Rai, learned counsel representing the Gaya Municipal Corporation.

Patna High Court CWJC No.383 of 2015 (6) dt.18-05-2015 Although Mr. Narain, learned senior counsel appearing for the petitioners has tried to espouse the case of the petitioners with reference to the rent enhancement present at Annexure-6 but the prayer made in the writ petition does not even make out any grievance against enhancement of rent rather all that the petitioners complain is harassment by the Municipal Commissioner by issuing a notice placed at Annexure-7 and according to Mr. Narain, the petitioners have also filed their reply.

Whereas the notice issued to the petitioners requiring them to be present with document cannot be a cause of grievance in so far as the issue of enhancement is concerned in absence of any prayer no direction can be issued. The writ petition is disposed of.

The interim order passed on 16.2.2015 stands vacated.
