JUSTICE SUDHIR SINGH ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bhabua P.S. Case No. 239 of 2013 for the offences instituted under Sections 326, 307/34 of the IPC and 27of the Arms Act. The prosecution story, in brief, is that while the informant was walking around 07.15 P.M. in the campus of Airport then some one fired on him from his back causing firearm injury in the left side of abdomen.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Further 164 Cr. P.C. statement of the victim is annexure-2 to the present application which shows that he had sustained firearm injury caused by

Patna High Court Cr.Misc. No.14965 of 2015 (3) dt.03-09-2015 2/2 Gautam Mishra. There is no allegation against the petitioner for causing any injury upon the victim.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bhabua P.S. Case No. 239 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhabua at Kaimur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
